What "casino" means on the German property market

The word covers two different things. A full casino (Spielbank) with roulette, blackjack and poker is tightly limited by the casino acts of the federal states. The states award these licences themselves, often to state-owned companies, and only for a small number of locations. Buying such a licence privately is not possible.

More often the term refers to gaming venues with slot machines, i.e. amusement arcades under Section 33i of the Trade Regulation Act that trade as a casino. These are governed by the Interstate Gambling Treaty, minimum-distance rules and the ban on multiple concessions. Which of the two a buyer has in mind shapes the entire due-diligence path.

What buyers of a casino property should check

Planning law comes first. Casinos and arcades count as entertainment venues and are only permitted by exception, or not at all, in many zones. The development plan, any local entertainment-venue bylaw and the existing building permit show whether the use is secured. A preliminary planning enquiry before signing provides certainty.

Next comes the permit. It is personal and does not transfer on sale. A buyer must prove reliability, expertise and a social concept on their own. Each state sets its own distances to other venues and to schools.

Buildings that also work without gaming hold their value best. Large open floor plates, plenty of parking and good road access allow alternatives such as hospitality, events or leisure uses. Lenders look closely at this alternative use.
